<p>The whiplash compensation claim</p>
<p>The first of the variable factors will depend on how you make your whiplash injury claim. If you make a compensation claim directly against the insurance company, then you will likely be compensated in accordance with the settlement agreement you make with the insurance company.</p>
<p>However, if you decide to seek the advice of a compensation solicitor to handle your whiplash compensation, then you could be entitled to compensation categorised as (i) general damages and (2) special damages.</p>
<p>General damages for whiplash</p>

<p><strong>Car insurance premiums have risen steeply in the last year at a rate of 5.9%, which is almost three times the rate of inflation as measured by the Consumer Price Index. The cause of this rise is being touted as an increase in the amount of compensation being paid out to car accident victims. Higher medical bills and ongoing care arrangements are costing insurers huge amounts in compensation and this is being reflected in the premiums they charge.</strong></p>
<p>In the mid 1990s the European New Car Assessment Programme was brought in as a measure of car safety across all car categories. It is now the accepted method for rating cars according to their ability to minimising the effects of a side or head on collision. Most new cars nowadays receive a 3 or 4 star rating due to better vehicle design and more safety features. The good news is that the likelihood of surviving a car crash is significantly higher in today&rsquo;s vehicles. The bad news is lawyers are cashing in on this by pushing for higher sums of compensation even for accident victims with minor injuries.</p>
<p>Legal costs have also increased significantly over the years earning traffic accident lawyers the title of &lsquo;ambulance chasers&rsquo;. The insurance industry claims that the cost of car accident claims is rising by 10 per cent every year, in part because of the legal fees involved. At present the average claim takes just under a year to settle with some cases being open for up to two years. For small claims under &pound;25,000 it has been suggested that a straight forward streamlined way of handling claims will mean fewer lawyers will need to be involved and bring down the costs of administering the claim.</p>
<p>However, it must be noted that the rising cost of compensation claims is not entirely due to increased compensation for the accident victim, but also due to the fact that newer safety features in cars cost more to fix and replace. Larger crumple zones and more airbags add to the cost of repairing the vehicle and this cost must be passed on to the drivers. Although due to the competitive nature of the insurance industry, premiums still need to be attractive in order to gain customers, not all of this cost will be charged in higher premiums.</p>
<p>But with 40 pence out of every &pound;1 in a compensation claim going to the lawyers, it is clear that the rising cost of insurance premiums is down to the legal system and if we want this to change, a way needs to be found for handling compensation claims more effectively and with less legal interventionUpdated</p>

<p><strong>You don&#8217;t have to be a teen these days to enjoy Facebook or other social networking sites. Even the odd lawyer (ahem) has been known to partake in this growing phenomenon.</strong></p>
<p>You may be under the impression that Facebook has no connection to an injury claim. Right? Think again.</p>
<p>Numerous court cases over the last year and a half in Ontario have held that an accident claimant is required to permit access to and save his or her Facebook materials to be shown to the insurer&#8217;s lawyers.</p>
<p>The right to access this personal information has been considered to be part of the discovery process that forms part of every lawsuit. However, the advent of this new source of potential information about the accident victim&#8217;s post-traumatic lifestyle has introduced a whole new invasive aspect to discovery.</p>
<p>An individual hired by the insurance company to to surveillance of a claimant will now automatically also do internet surveillance. If, like many people, you use your Facebook profile as a journal or chronical of your day, you could be providing significant fodder to the insurance company. Plus, because of the dynamic nature of the sites, you will not have a record of what you said six months ago on a particular day. However, if that is a day the insurance company was monitoring, the insurance company will have that record and may use it against you.</p>
<p>Using MySpace, or Facebook, the insurer can see your trip pictures, read commentary about your outings or otherwise glean or conclude that you are not affected by the accident the way you claim to be.</p>
<p>The difficulty for injured victims is that there is probably a very reasonable explanation for why you wrote &#8220;I danced until dawn&#8221; in your online profile. However, by the time you get to trial, you will have forgotten what it was! The jury is left with this admission, by you, to contrast with your stated disabilities.</p>
<p>Our firm has asked our injured clients not to participate in this type of on-line activity. Where using these sites is unavoidable, the claimants must be wary of what is posted. This includes not only their own profiles, but also on friends and family members&#8217; profiles too.</p>
<p>Watch for photos &#8220;tagging you&#8221; too from parties or weddings.</p>
<p>A claims examiner or insurance defence lawyer is not who you want listed on your site as your &#8220;friend&#8221;.</p>

<p>You may have been bitten by a dog whilst going out for a walk on your own or with your family whatever the circumstances this should have never happened to you. You also may have been walking your dog and another dog has tried to attack your dog and you have tried to stop this from happening and in the process have got yourself bitten. None of this is your fault and this dog should never have bitten you and therefore you have a right to claim compensation for your pain and suffering.</p>

<p><strong>You can claim compensation for many different types of accidents. Some of the most common accidents are road traffic accidents including motorcycle accidents, accidents a work, slip and trips in supermarkets or on uneven pavement. Other claims include industrial diseases, construction accidents, holiday accidents, dog bite injury, medical negligence, product liability and asbestos claims.</strong></p>
<p>The list could go on and on. Basically if you have had an accident where you were injured but the accident was not the fault of your own and caused by someone else&#8217;s recklessness then you are entitled to claim compensation. If the accident was partly someone else&#8217;s fault you will still have a claim, you just may not get as much compensation.</p>
<p>Many people believe that claiming compensation for an accident is difficult and time consuming and very expensive. This could not be further from the truth. It is quite possible that in the past claiming compensation was a lot harder. These days it is a very simple process that will cost you nothing. In 1988 the Conditional Fee Agreement was brought in to place replace legal aid with regards to compensation claims. This agreement also known as no win no fee makes claiming compensation available to everyone and anyone for no cost to yourself. It is a great way of giving justice back to everyday people. Before this agreement was put in place only people who were entitled to legal aid would put in claims if they even bothered at all.</p>
<p>Those on higher incomes where legal aid is not available were put off by the legal fees and worried they wouldn&#8217;t win the cases and then end up even more out of pocket. These no win no fee agreements are available to anyone from any income or background.</p>
<p>With no win no fee claims your solicitor basically takes the case on and works for nothing. Once the case is won his fees are paid by the losing parties insurance and if you have occurred any charges for the use of government bodies or for medical records during your no win no fee claim; your expenses are refunded to you. You will also get 100% of any compensation awarded to you, without any deductions from your solicitor or anyone. What you need to realise here is that solicitors will not work for nothing which means they will only take on cases they are sure they can win. Compensation claims are really quite easy, if you can prove the accident wasn&#8217;t your fault and also prove that you were by no means to blame you have a winning case.</p>
<p>A solicitor will be able to tell you over the phone if you have a case. There is &#8216;after the event&#8217; insurance available for the small chance that your case is lost so your solicitor will still be able to claim back their fees. Again still at no cost to yourself.</p>
<p>The only time you may have to cough up is when medical records are needed; the cost of this can come out of the final payout if you wish though, and again the insurance is available for lost cases.</p>
<p>Once you have contacted a personal injury solicitor and they believe you have a case they will send you a form to complete. This is the only bit of hard work on your behalf. You will have to fill out all the details of the accident including times dates, people evolved, witnesses etc. It will even ask you to draw a picture of the accident. It is handy to create a record of all this information as soon after the accident as possible because as times goes on you might forget details. You should also keep a check of expenses since the accident, like how many miles and times you had to go to the doctor or hospital. How many days off work you had, even a diary of the actual pain you were put under will help the overall case.</p>
<p>On winning the case you will get all of your out of pocket expenses back which is why it is important to list everything even minor expenses as it all adds up. If you broke your expensive favourite watch in the accident but forget to mention it you will not get a refund for it.</p>
<p>So now you know how to go about making an accident claim and realise it is not an expensive or difficult process you can go about finding a good accident claim solicitor. Remember claiming compensation is your legal and civil right. Those that don&#8217;t claim are only fools, they are letting the insurance companies get away with not have to cough up. <p>The announcement coincides with the Irish Government&#8217;s trade development mission to South Africa headed by Irish Prime Minister, An Taoiseach, Bertie Ahearn, and Minister for Enterprise, Trade and Employment, Micheal Martin. The aim of the visit is to support Irish companies in developing a presence in South Africa through trade, investment, partnership and other business linkages. <p>The RAF is the government body that operates South Africa&#8217;s compensation programme for people injured in road accidents or the dependants of people killed in accidents arising from the negligent driving of a motor vehicle. It employs 1700 staff and in 2007 processed 260,903 claims and paid out approximately R6.6 billion (EU655 million). In recent times, it has faced a number of challenges (including a backlog of approximately 380,000 claims) that led it to carry out an in-depth internal review of its IT systems, human resources, service delivery, and communications. A new business model was eventually agreed to secure the long term future of the RAF and enable it to achieve its strategic objectives. A key component of the plan was the introduction of a new claims management system. According to Jacob Modise, CEO of RAF, &#8220;The new solution is intended to replace the legacy system within the RAF which continues to fail our accident victims and does not lend itself to efficient processing of claims.&#8221;</p>
<p>Rather than devise a new claims system from scratch, the RAF commissioned a team of consultants from KPMG to review proven solutions in similar enterprises around the world. FINEOS has a well-established track record in the area of managing claims for accident compensation and bodily injury. Its deployment at the Accident Compensation Corporation (ACC) of New Zealand is one of the largest public sector projects in the country in the last decade. <p><strong>When you&rsquo;re out and driving, there&rsquo;s nothing worse than getting in an accident. Whether it&rsquo;s just a fender bender or a windshield-cracking, door-shredding crash, accidents are horrible things to witness and worse to experience, not to mention the cost of the accident claims that may result.</strong></p>
<p>If you&rsquo;re on a motorcycle, accidents become even worse. More than three thousand motorcycle accidents resulted in death last year in the United States alone, and the numbers are just as terrifying in the United Kingdom. With nothing between you and the other vehicle to absorb the impact, motorcycle accidents can be much more injurious than those sustained in a normal vehicle.</p>
<p>Motorcycle accidents are sometimes caused by poor maintenance&mdash;because a motorcycle only has two wheels, it is inherently more unstable than cars or trucks, and requires more careful maintenance to ensure safety out on the road. A slightly misaligned tire can result in a fatal crash, as can an engine or brake failure, so always make sure your motorcycle is in top shape.</p>
<p>Also, check the tyres themselves. If you leave your tyres too long without getting them replaced, the treads can wear away. These bald tyres can lead to fatal motorcycle accidents, especially in snowy conditions or on wet roads where bald tyres are more likely to hydroplane. Have your mechanic check your tyres and make sure they&rsquo;re still good to ride on.</p>
<p>Bad roads can lead to fatal motorcycle accidents as well. The government can only repair so many roads at a time, and some roads go for years without ever seeing the attention of a road crew. These roads can be treacherous enough to normal cars and trucks, with loose gravel and big potholes that can swallow a tire whole. If you&rsquo;re on a motorcycle, that pothole can flip your motorcycle over and throw you onto the street, so you have to be a lot more careful. On bad roads, slow down and keep your eyes open, and avoid otherwise very painful motorcycle accidents.</p>
<p>There are plenty of other conditions which may lead to bad motorcycle accidents. Watch out for debris on the road &ndash; a nail in the tire at sixty miles and hour could lead to a potentially fatal blow-out. Also, sometimes things get spilled on the road &ndash; say a truck has an oil leak and is spilling oil onto the road as it drives. Oil isn&rsquo;t the most friction conducive material it&rsquo;s possible to put on a road, and driving over a patch could lead to a slide out and loss of control over your motorcycle. Watch for dark patches on the road that indicate spilled oil.</p>
<p>Then there&rsquo;s ice. With as much rain as Britain gets, ice is fairly common whenever it gets cold, and when it&rsquo;s present you have to be especially careful. In a car, a spinout could lead to ending up in a ditch. In a motorcycle, loss of control usually leads to a motorcycle accident &ndash; at the best, bruises or broken bones, at the worst, death. The human body isn&rsquo;t made to slam into asphalt at sixty miles an hour, and won&rsquo;t react well if it does. If there is ice on the road, drive slowly and very carefully, and you&rsquo;ll come through all right.</p>
<p>Alcohol and drugs, of course, are an obvious problem. They impair judgment and turn otherwise good drivers into dangerous ones &ndash; the only good part of driving a motorcycle drunk is that when you crash you probably won&rsquo;t take anyone else with you. The bad news is, you&rsquo;ll still be just as dead. Sleep deprivation is nearly as bad, so make sure you&rsquo;re always well rested before driving. Remember, because of the small size and low profile of motorcycles, drivers of cars will have a harder time seeing you. The responsibility of safety is up to you, so take it seriously.</p>

<p>This is a pressing problem as the National Institute of Mental Health has released figures which show that in a 12 month period, over six per cent of employed individuals reported suffering from a major depressive disorder.</p>
<p>And that figure is even higher when removing the year long time span. As many as sixteen per cent of employed individuals will suffer from depression at some point during their lives.</p>

<p><strong>Intellectual property (IP) is a catch-all term that covers creations of the mind, or intellect, that are both commercial and artistic in nature.</strong></p>
<p>There are two categories of such property, the first of which includes creative works such as books, movies, music, paintings, photographs and software. These are covered by copyright laws, which offer copyright holders the exclusive right to control the adaptation or replication of the works for a certain statutory period of time.</p>
<p>The second category, known as &#8220;industrial properties,&#8221; includes those things created for industrial or commercial uses. Patents give the inventor and/or patent holder the right to stop others from using the invention unless they pay a license fee (again, for a certain period of time). Trademarks, also a kind of industrial property, are distinctive signs that reduce the confusion among similar kinds of products.</p>
<p>&ldquo;Intellectual property rights&#8221; includes, as a subset, industrial design rights, and these protect the particular appearance, design, form, style or design of industrial object from various kinds of infringement, such as being cloned, copied or counterfeited. Another type of intellectual property is a trade secret, meaning proprietary, normally confidential information about the commercial products or practices of a business. Disclosing trade secrets to the public without permission is illegal in most jurisdictions.</P><br />
<P>A short history lesson<br />If creators of intellectual property were not protected, they would have little incentive to continue researching and developing products for public use, and would tend to keep things secret. Therefore, economic growth in the industrialized nations is, to a large extent, dependent on the protections afforded inventors, writers and artists by IP laws.</P><br />
<P>According to some economists, some 60-70% of the value of large U.S. corporations is attributable to intangible assets. Of course, correlation is not causation, but the observation is an important one. Clearly, the establishment of a legal framework to protect intellectual property is an important step in the maturation of the younger, Pacific Rim economies, as well as the countries of the former Soviet Union.</P><br />
<P>In point of fact, intellectual property rights are really a simple form of temporary monopoly that is enforced by the government, and subject to the legal proceedings of that government&rsquo;s judicial system. The more mature and ingrained this outlook is in a nation and economy, the better.</P><br />
<P>Types of goods<br />Rights in intellectual property are normally limited to what are called &ldquo;non-rival&rdquo; goods, meaning goods that are used by a number of people at the same time, where use by one person neither prevents nor excludes use by someone else. On the other hand, &ldquo;rival&rdquo; goods, such as clothing, are used by just one person at a time. By way of analogy, any number of people can use a math formula or a cake recipe simultaneously. <P>Because &ldquo;non-rival&rdquo; goods can be copied, for instance, by many people at the same time &ndash; in economic terms, &ldquo;produced at zero marginal cost&rdquo; &ndash; creators have no incentive at all to develop such works. Of course, monopolies also have their own inefficiencies, as some producers will raise prices and reduce production in ways that are not &ldquo;maximized&rdquo; for social benefit.</P><br />
<P>The intellectual property rights system, then, is best thought of as a trade-off, one meant to balance societal interests with monopoly power in the creation of non-rival good. In other words, the developing IP structures encourage research, development and creation of new things, new products, new ideas, and new processes.</P><br />
<P>Making these trade-offs and strategizing IP issues, as an industry or even a nation, is a daunting task. The best hope we have is that a string of judicial decisions and business actions will chart a course through the confusion. In the meantime, it is important to remember that the existing framework is not set in stone, and is subject to changes both subtle and dramatic. <p><strong>The results of a recent AA survey on highway safety should come as no surprise to any long suffering motorist. Almost three in four (72%) of those polled thought road and junction improvements would make roads safer, reducing the annual number of car accident claims.</strong></p>
<p>Only 25% thought having more traffic police would help and just 4% reckoned more speed cameras would do the trick.</p>
<p>The latest in a succession of surveys by the AA and Populus, the findings also revealed:</p>
<p>:: 82% of drivers aged 18 to 24 and 77% of women motorists in particular felt that fixing unsafe roads was the best option to make roads safe;</p>
<p>:: Of those that supported the safety benefits of having more traffic police, men were much more in favour than women;</p>
<p>:: Only 16% of younger drivers wanted more traffic police compared to 29% of over-65s;</p>
<p>:: Those in north-east England and Scotland were most likely to favour improving road danger spots, with those living in London least likely to want road improvements and most in favour of more traffic police (27%);</p>
<p>:: People in Northern Ireland were most likely to want more speed cameras (7%) while those in north-east England were least supportive (2%).</p>
<p>AA president Edmund King said: &#8220;Making UK roads safer requires a broad approach with safe cars, safe drivers and safe roads. Keeping these measures in balance is the key. Drivers are now telling us that it is time to target the dangerous roads and junctions that we all know exist.</P><br />
<P>&#8220;The motorist is paying record amounts in motoring taxation so more of this should be spent on life-saving road improvements. The poll also shows that six times as many people want more traffic police rather than more speed cameras.&#8221;</P><br />
